Kulbhushan case: ICJ to deliver verdict on Jadhav

The International Court of Justice (ICJ) in The Hague will deliver its judgment in the Kulbhushan Jadhav case at 3 pm (6:30 pm EST) Wednesday at the Peace Palace in the Netherlands.
According to a statement by the ICJ, Judge Abdulqawi Ahmed Yusuf, president of the UN judicial body, will deliver the judgment. Fifteen other members of the group - including the representative of Pakistan - will fully subscribe to the final verdict or read favorable or dissenting opinions. Officials familiar with the work of the ICJ say the process could last from a few minutes to more than an hour.

Indian officials said they hoped to see the International Court of Justice judge Jadhav's trial in 2017 and declare the death sentence passed on the former Indian naval officer "illegal" by a Pakistani military court. Pakistan, meanwhile, hopes that the Indian petition submitted to the ICJ will be rejected.
The verdict will end India's two-year quest for a stay of Kulbhushan Jadhav, who, according to the government, has been convicted of false terrorism charges in Pakistan.

India has taken a dual approach: to argue that the Jadhav trial in a military court was only quasi-judicial and that there was no internationally recognized procedure, and that Pakistan had violated the Vienna Convention on consular relations, which stipulates that foreign nationals undergoing trial be offered consular access.

In the petition, India had asked the ICJ to suspend Mr. Jadhav's death sentence, to prevent Pakistan from applying the verdict of the military court, to give the government consular access to Mr. Jadhav and to totally cancel the trial. Finally, the government asked the ICJ to instruct Pakistan to "immediately release the convicted Indian national".
